Terms & Conditions of Sale

a) The Seller shall invoice the Purchaser upon receipt of a verbal or written order for the Products. All invoices are payable upon order. If the Purchaser requires other Terms then written authorisation must be obtained from the Seller prior to any other Terms being implemented.

b) Without prejudice to its other rights and remedies hereunder and at law the Seller reserve the right to charge the Purchaser interest in respect of late payment of any sum due hereunder at the rate of 2.5 per cent per annum over NatWest Bank plc base rate from time to time from the due date of payment until payment of full principle amount plus interest in full.

3. Delivery of Products

a) Each order shall represent a separate contract and any failure or default of the Seller in respect of any one delivery shall not entitle the Purchaser to treat the contract as a whole as repudiated.

b) The Seller shall deliver the Products within a reasonable time and shall if possible comply with any sensible stipulation of the Purchaser as to the time of delivery. The Seller shall not be liable under any liability as a result of delay in delivery or for any consequences of such delay.

c) The Products will be dispatched by the Seller or via independent carrier at the Sellers risk only when using the Sellers normal means of delivery.

d) Failure to accept delivery may result in handling and storage charges being applied until delivery is accepted.

4. Claims for Products

a) Claim for damage, loss or theft in the case of Products must be made within three days of their receipt. Damage or evidence of theft must be held by the Purchaser for return of goods.

b) If the Purchaser does not so notify the Seller in accordance with the above clause the Purchaser shall be deemed to have accepted the Products.

c) The Sellers liability in respect of any Products found to be defective is limited to the replacement of those Products provided that the defective Products are returned or placed at the Sellers disposal.

5. Price Lists

a) A price list is not an offer but an invitation to the Purchaser to make an offer on the Terms and Conditions set out herein and on the current price list.

b) Prices are subject to change without notification and orders received from a Purchaser will be accepted at the current prices at the date of order.

6. Cancellation / Returns Policy

a) You have the right to cancel your order at any time before a confirmed delivery date free of charge. You have the right to cancel your order within 7 working days of receiving your products without giving a reason providing the goods are in a re-saleable condition. However the customer does have to pay the cost of returning the goods to us (£7.50 or at your own cost).

b) If you have decided to cancel your order or wish to return your products to Tackle Frenzy, we will refund your credit card within 3 working days of receipt of the goods subject to the goods being in re-saleable condition..

c) This section has been introduced to incorporate the new European Directive on distance selling which is incorporated into UK law by The Consumer Protection (Distance Selling) Regulations 2000. Further information on this can be found on the Department of Trade and Industry.

7. Insolvency

If the Purchaser goes into liquidation, becomes bankrupt, or becomes the subject of an administration order, or a receiver is appointed over any of its property or assets, or makes any voluntary arrangements with its creditors, or ceases or threatens to cease to carry on business, the seller shall be entitled to recover all of the Products that belong to the Seller and the Purchaser shall not impede this collection in any way.

8. Liability

a) The following provisions set out the sellers entire liability (including any liability for the acts and omissions of its employees, agents or subcontractors) to the Purchaser in respect of the following: i. Any breach of the sellers contractual obligations arising under this agreement ii. Any representation, statement, act or omission including negligence arising under or in connection with this Agreement any such act or omission shall be known as “an Event Of Default”.

b) The Sellers liability for death or personal injury resulting from its own negligence or that of its employees, agents or subcontractors, shall not be limited.

c) Subject to 8(b) the Seller shall not be liable to the Purchaser for loss of profits or any other indirect or consequential losses howsoever arising.

d) Subject only to 8(b) the Seller’s entire liability in respect of any Event Of Default or series of connected Events Of Default shall be limited to the price of the Products.

9. These Terms and Conditions shall be governed by and construed in accordance with English law.
